This Privacy Policy describes the privacy practices of DTLA Fitness Ventures, LLC, doing business as Lagree213 (“we”, “our”, “us”, or “the Company”) with respect to personal information collected from individuals who access our website at www.lagree213.com (the “Site”), visit our studio locations, or otherwise interact with us (collectively, “Users” or “you”). 

Grounds for data collection 

We collect, use, and disclose personal information (meaning information that identifies, relates to, describes, or could reasonably be linked, directly or indirectly, with a particular consumer or household; hereinafter “Personal Information”) as necessary to perform our contractual obligations to you, provide you with our services, and comply with applicable legal obligations 

When you use the Site, you consent to the collection, storage, use, disclosure and other uses of your Personal Information as described in this Privacy Policy. 

We encourage our Users to carefully read the Privacy Policy and use it to make informed decisions. 

What information do we collect? 

We collect two types of data and information from Users. 

The first type of information is un-identified and non-identifiable information pertaining to a User(s), which may be made available or gathered via your use of the Site (“ Non-personal Information ”). We are not aware of the identity of a User from which the Non-personal Information was collected. Non-personal Information which is being collected may include your aggregated usage information and technical information transmitted by your device, including certain software and hardware information (e.g. the type of browser and operating system your device uses, language preference, access time, etc.) in order to enhance the functionality of our Site. We may also collect information on your activity on the Site (e.g. pages viewed, online browsing, clicks, actions, etc.). 

The second type of information Personal Information which is individually identifiable information, namely information that identifies an individual or may with reasonable effort identify an individual. Such information includes: 

● Device Information: We collect Personal Information from your device. Such information includes geolocation data, IP address, unique identifiers (e.g. MAC address and UUID) and other information which relates to your activity through the Site. 

● Registration information: When you register to our Site you will be asked to provide us certain details such as: full name; e-mail or physical address, and other information.

For purposes of the CCPA, the categories of Personal Information described above fall within the following statutory categories: identifiers (name, email address, postal address, telephone number, unique online identifiers, IP address); customer records information (account registration details, billing and payment information); internet or other electronic network activity information (browsing history and interaction with our Site); geolocation data; and commercial information (membership history and services purchased). 

We do not collect, store, or retain biometric information, health information, or other sensitive personal information in connection with body composition scans (e.g., InBody scans) offered as a membership perk. Scan results are provided to members as a printed report only and are not retained by us in any form. 

How do we receive information about you? 

We receive your Personal Information from various sources: 

● When you voluntarily provide us your personal details in order to register on our Site; 

● When you use or access our Site in connection with your use of our services; 

● From third party providers, services and public registers (for example, traffic analytics vendors). 

What information do we share? 

We do not sell Personal Information for monetary consideration. For purposes of the CCPA, we “share” certain categories of Personal Information (specifically, identifiers and internet or electronic network activity information such as IP address and browsing behavior on our Site) with third-party advertising and analytics partners, including Google Analytics, for cross-context behavioral advertising. You have the right to opt out of this sharing at any time. See “Your California Privacy Rights” and “Your Privacy Choices” below. 

We may use the information for the following: 

● Communicating with you – sending you notices regarding our services, providing you with technical information and responding to any customer service issue you may have; 

● To communicate with you and to keep you informed of our latest updates and services; 

● To serve you advertisements when you use our Site (see more under "Advertisements"); 

● To market our websites and products (see more under "Marketing"); 

● Conducting statistical and analytical purposes, intended to improve the Site 

In addition to the different uses listed above, we may transfer or disclose Personal Information to our subsidiaries, affiliated companies and subcontractors. 

In addition to the purposes listed in this Privacy Policy, we may share Personal Information with our trusted third party providers, who may be located in different jurisdictions across the world, for any of the following purposes: 

Hosting and operating our Site;

● Storing and processing such information on our behalf; 

● Serving you with advertisements and assist us in evaluating the success of our advertising campaigns and help us retarget any of our users;

Phone numbers and other information collected as part of SMS opt-in consent are stored in our customer relationship management and booking platform along with other account information and are shared with that platform provider solely as a service provider to operate our SMS, scheduling, and account management functions. We do not use SMS opt-in information for cross-context behavioral advertising, and we do not share SMS opt-in information with any third party for the third party’s own marketing or advertising purposes 

We may also disclose information if we have good faith to believe that disclosure of such information is helpful or reasonably necessary to: (i) comply with any applicable law, regulation, legal process or governmental request; (ii) enforce our policies (including our Agreement), including investigations of potential violations thereof; (iii) investigate, detect, prevent, or take action regarding illegal activities or other wrongdoing, suspected fraud or security issues; (iv) to establish or exercise our rights to defend against legal claims; (v) prevent harm to the rights, property or safety of us, our users, yourself or any third party; or (vi) for the purpose of collaborating with law enforcement agencies and/or in case we find it necessary in order to enforce intellectual property or other legal rights. 

Your California Privacy Rights 

If you are a California resident, you have the following rights under the CCPA: 

● Right to Know/Access: You may request that we disclose the categories and specific pieces of Personal Information we have collected about you, the categories of sources, our purposes for collecting it, and the categories of third parties with whom we share it. 

● Right to Delete: You may request that we delete Personal Information we have collected from you, subject to certain exceptions (for example, where retention is necessary to complete a transaction, comply with a legal obligation, or for internal uses reasonably aligned with your expectations) 

● Right to Correct: You may request that we correct inaccurate Personal Information we maintain about you. 

● Right to Opt Out of Sale/Sharing: You may direct us to stop sharing your Personal Information for cross-context behavioral advertising purposes. See “Your Privacy Choices” below 

● Right to Non-Discrimination: We will not discriminate against you for exercising any of these rights 

You may submit a request to know, delete, or correct by (1) emailing us at info@lagree213.com, or (2) submitting a request through the contact form on our Site at www.lagree213.com We will verify your identity before processing your request using information you have already provided to us. You may designate an authorized agent to submit a request on your behalf by providing written authorization. 

We will respond to verifiable requests within 45 days of receipt. If we require additional time (up to an additional 45 days), we will inform you of the reason and extension period in writing. 

Your Privacy Choices

You may also opt out of third-party ad networks directly through the Network Advertising Initiative (optout.networkadvertising.org) and the Digital Advertising Alliance (optout.aboutads.info). 

California “Shine the Light” 

California Civil Code Section 1798.83 permits California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. Retention 

We will retain your personal information for as long as necessary to provide our services, and as necessary to comply with our legal obligations, resolve disputes, and enforce our policies. Retention periods will be determined taking into account the type of information that is collected and the purpose for which it is collected, bearing in mind the requirements applicable to the situation and the need to destroy outdated, unused information at the earliest reasonable time. Under applicable regulations, we will keep records containing client personal data, account opening documents, communications and anything else as required by applicable laws and regulations. 

We may rectify, replenish or remove incomplete or inaccurate information, at any time and at our own discretion. 

Cookies 

We and our trusted partners use cookies and other technologies in our related services, including when you visit our Site or access our services. 

A "cookie" is a small piece of information that a website assign to your device while you are viewing a website. Cookies are very helpful and can be used for various different purposes. We use Google Analytics to collect information about use of the Site, including IP address and browsing activity. This information is shared with Google for analytics purposes and may be used for cross-context behavioral advertising as described above under “What information do we share?” You can opt out of this sharing by visiting our Your Privacy Choices page or through Google’s own opt-out tools. Google’s ability to use and share information collected by Google Analytics about your visits to this Site is restricted by the Google Analytics Terms of Use and the Google Privacy Policy. 

Third party collection of information 

Our policy only addresses the use and disclosure of information we collect from you. To the extent you disclose your information to other parties or sites throughout the internet, different rules may apply to their use or disclosure of the information you disclose to them. Accordingly, we encourage you to read the terms and conditions and privacy policy of each third party that you choose to disclose information to. 

This Privacy Policy does not apply to the practices of companies that we do not own or control, or to individuals whom we do not employ or manage, including any of the third parties which we may disclose information as set forth in this Privacy Policy. 

How do we safeguard your information? 

We take great care in implementing and maintaining the security of the Site and your information. We employ industry-standard administrative, technical, and physical safeguards designed to protect Personal Information from unauthorized access, use, alteration, or disclosure, including restricted access controls, encryption of data in transit, and routine review of our security practices, and we require service providers who process Personal Information on our behalf to maintain comparable safeguards. SMS Terms and conditions 

1. Information obtained as part of the SMS consent process is stored in our customer relationship management and booking platform and is not shared with third parties for their own marketing or advertising purposes. 

2. Frequency and Types of SMS communications – If you have consented to receive text messages from lagree213.com you may receive 3 text messages per week related to customer service topics. External communications with our clients is to support the needs of the client in regards to scheduling, account management, schedule changes, services, promotions, and troubleshooting. 

3. Opt-in / Opt-out – To opt-in, text ‘START’ to (213) 863-4834. You can opt-out at any time by texting “Stop”, for assistance type “Help” or visit our privacy policy and/or terms of service at https://www.lagree213.com/privacy-policy. 

Advertisements 

We may use a third-party advertising technology to serve advertisements when you access the Site. This technology uses your information with regards to your use of the Services to serve advertisements to you (e.g., by placing third-party cookies on your web browser). 

You may opt-out of many third-party ad networks, including those operated by members of the Network Advertising Initiative ("NAI") and the Digital Advertising Alliance ("DAA"). Marketing 

We may use your Personal Information, such as your name, email address, telephone number, etc. ourselves or by using our third party subcontractors for the purpose of providing you with promotional materials, concerning our services, which we believe may interest you. 

Out of respect to your right to privacy we provide you within such marketing materials with means to decline receiving further marketing offers from us. If you unsubscribe we will remove your email address or telephone number from our marketing distribution lists. 

Please note that even if you have unsubscribed from receiving marketing emails from us, we may send you other types of important e-mail communications without offering you the opportunity to opt out of receiving them. These may include customer service announcements or administrative notices. 

Corporate transaction 

We may share information in the event of a corporate transaction (e.g. sale of a substantial part of our business, merger, consolidation or asset sale). In the event of the above, the transferee or acquiring company will assume the rights and obligations as described in this Privacy Policy. 

Minors 

We understand the importance of protecting children’s privacy, especially in an online environment. The Site is not designed for or directed at children. Under no circumstances shall we allow use of our services by minors without prior consent or authorization by a parent or legal guardian. We do not knowingly collect Personal Information from minors. When you register to use Lagree213, your email will automatically be listed in the Lagree213 mailing list. You will receive welcome information, account information, and other marketing related information.You may also receive periodic emails from us notifying you of new features, products, titles, and other related information for Lagree213 services.You may choose to opt out of receiving emails from Lagree213, but if You choose to do so, You may not receive technical support requests, account updates and notifications, product updates, security updates or updates to the Terms of Services of Lagree213 as well as updates to Privacy Policy of Lagree213. 

SMS Messaging 

When you register to use Lagree213 services, your phone number will be part of the Lagree213 messaging list as you are consenting to receive recurring text notifications from us. You will receive welcome information and other marketing related information related to Lagree213 services, including periodic SMS messages from us notifying you of new features or other related Lagree213 information. You will receive all of these even if your mobile number is registered on any state or federal do-not-call list. Message frequency varies. 

You may choose to opt out of receiving SMS messages from Lagree213 by replying ‘STOP’ to any message sent from us. If You choose to do so, You may not receive technical support requests, account updates and notifications, product updates, security updates or updates to the Terms of Services of Lagree213 as well as updates to Privacy Policy of Lagree213. You understand and agree that alternative methods of opting out, such as using alternative words or requests, will not be considered a reasonable means of opting out. 

We do not charge for the service, however you are responsible for all charges and fees associated with text messaging and SMS imposed by your wireless provider. Message and data rates may apply. 

We have the right to modify any telephone number or short code we use to operate the service at any time. You will be notified on such occasions. 

You agree that any messages you send to a telephone number or short code we have changed, including any STOP or HELP requests, may not be received, and we will not be liable for honoring requests made in such messages. 

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service. 

Data Breach Notification 

n the event of a breach of security affecting your Personal Information, we will notify you in accordance with California Civil Code Section 1798.82, without unreasonable delay, consistent with the legitimate needs of law enforcement and any measures necessary to determine the scope of the breach and restore the integrity of our systems. 

CAN SPAM Act 

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.
