This Privacy Policy describes the privacy practices of DTLA Fitness Ventures, LLC, doing business as Lagree213 (“we”, “our”, “us”, or “the Company”) with respect to personal information collected from individuals who access our website at www.lagree213.com (the “Site”), visit our studio locations, or otherwise interact with us (collectively, “Users” or “you”).
We collect, use, and disclose personal information (meaning information that identifies, relates to, describes, or could reasonably be linked, directly or indirectly, with a particular consumer or household; hereinafter “Personal Information”) as necessary to perform our contractual obligations to you, provide you with our services, and comply with applicable legal obligations
When you use the Site, you consent to the collection, storage, use, disclosure and other uses of your Personal Information as described in this Privacy Policy.
We encourage our Users to carefully read the Privacy Policy and use it to make informed decisions.
We collect two types of data and information from Users.
The first type of information is un-identified and non-identifiable information pertaining to a User(s), which may be made available or gathered via your use of the Site (“ Non-personal Information ”). We are not aware of the identity of a User from which the Non-personal Information was collected. Non-personal Information which is being collected may include your aggregated usage information and technical information transmitted by your device, including certain software and hardware information (e.g. the type of browser and operating system your device uses, language preference, access time, etc.) in order to enhance the functionality of our Site. We may also collect information on your activity on the Site (e.g. pages viewed, online browsing, clicks, actions, etc.).
The second type of information Personal Information which is individually identifiable information, namely information that identifies an individual or may with reasonable effort identify an individual. Such information includes:
● Device Information: We collect Personal Information from your device. Such information includes geolocation data, IP address, unique identifiers (e.g. MAC address and UUID) and other information which relates to your activity through the Site.

For purposes of the CCPA, the categories of Personal Information described above fall within the following statutory categories: identifiers (name, email address, postal address, telephone number, unique online identifiers, IP address); customer records information (account registration details, billing and payment information); internet or other electronic network activity information (browsing history and interaction with our Site); geolocation data; and commercial information (membership history and services purchased).
We do not collect, store, or retain biometric information, health information, or other sensitive personal information in connection with body composition scans (e.g., InBody scans) offered as a membership perk. Scan results are provided to members as a printed report only and are not retained by us in any form.
We receive your Personal Information from various sources:
● When you voluntarily provide us your personal details in order to register on our Site;
● When you use or access our Site in connection with your use of our services;
● From third party providers, services and public registers (for example, traffic analytics vendors).
We do not sell Personal Information for monetary consideration. For purposes of the CCPA, we “share” certain categories of Personal Information (specifically, identifiers and internet or electronic network activity information such as IP address and browsing behavior on our Site) with third-party advertising and analytics partners, including Google Analytics, for cross-context behavioral advertising. We may use the information for the following:
● Communicating with you – sending you notices regarding our services, providing you with technical information and responding to any customer service issue you may have;

Phone numbers and other information collected as part of SMS opt-in consent are stored in our customer relationship management and booking platform along with other account information and are shared with that platform provider solely as a service provider to operate our SMS, scheduling, and account management functions. We do not use SMS opt-in information for cross-context behavioral advertising, and we do not share SMS opt-in information with any third party for the third party’s own marketing or advertising purposes
We may also disclose information if we have good faith to believe that disclosure of such information is helpful or reasonably necessary to: (i) comply with any applicable law, regulation, legal process or governmental request; (ii) enforce our policies (including our Agreement), including investigations of potential violations thereof; (iii) investigate, detect, prevent, or take action regarding illegal activities or other wrongdoing, suspected fraud or security issues; (iv) to establish or exercise our rights to defend against legal claims; (v) prevent harm to the rights, property or safety of us, our users, yourself or any third party; or (vi) for the purpose of collaborating with law enforcement agencies and/or in case we find it necessary in order to enforce intellectual property or other legal rights.

You may designate an authorized agent to submit a request on your behalf by providing written authorization.
We will respond to verifiable requests within 45 days of receipt. If we require additional time (up to an additional 45 days), we will inform you of the reason and extension period in writing.

We will retain your personal information for as long as necessary to provide our services, and as necessary to comply with our legal obligations, resolve disputes, and enforce our policies. Retention periods will be determined taking into account the type of information that is collected and the purpose for which it is collected, bearing in mind the requirements applicable to the situation and the need to destroy outdated, unused information at the earliest reasonable time. Under applicable regulations, we will keep records containing client personal data, account opening documents, communications and anything else as required by applicable laws and regulations.
We may rectify, replenish or remove incomplete or inaccurate information, at any time and at our own discretion.

2. Frequency and Types of SMS communications – If you have consented to receive text messages from lagree213.com you may receive 3 text messages per week related to customer service topics. External communications with our clients is to support the needs of the client in regards to scheduling, account management, schedule changes, services, promotions, and troubleshooting.

When you register to use Lagree213 services, your phone number will be part of the Lagree213 messaging list as you are consenting to receive recurring text notifications from us. You will receive welcome information and other marketing related information related to Lagree213 services, including periodic SMS messages from us notifying you of new features or other related Lagree213 information. You will receive all of these even if your mobile number is registered on any state or federal do-not-call list. Message frequency varies.
You may choose to opt out of receiving SMS messages from Lagree213 by replying ‘STOP’ to any message sent from us. We do not charge for the service, however you are responsible for all charges and fees associated with text messaging and SMS imposed by your wireless provider. Message and data rates may apply.
We have the right to modify any telephone number or short code we use to operate the service at any time. You will be notified on such occasions.
You agree that any messages you send to a telephone number or short code we have changed, including any STOP or HELP requests, may not be received, and we will not be liable for honoring requests made in such messages.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
